Section 8 Possession Playbook: How to Make a Claim Stick in England
Section 21 is gone. The Landlord Possession & Compliance Playbook is a 31-page, plain-English system for a Section 8 claim that holds up: Form 3A, the compliance checklist and the mistakes that sink claims.

This is the position on 2 November 2026, England, assured tenancies. It is general information, not legal advice.
Why most possession claims fail on paperwork
The ground is rarely the problem. A compliance slip from months earlier is. If the groundwork is wrong, the judge dismisses your claim, not the tenant's defence, and you start again while the arrears keep climbing.
Three slips come up again and again: a deposit that was not protected with the prescribed information served, a gas safety certificate never handed over or an out-of-date electrical report, and the wrong form or notice period. Each hands the tenant an easy defence.
What changed on 1 May 2026
Section 21 no-fault possession is abolished. Assured shorthold tenancies became assured periodic tenancies, and a landlord who wants possession needs a Section 8 ground. If your process was built around Section 21, it needs rebuilding. GOV.UK explains the new route, and our guide to what landlords must do now covers the wider changes.
The new Section 8 notice: Form 3A
Section 8 notices now go on Form 3A, the new notice for private landlords. Using the old form, or the wrong notice period for the ground, can get the whole notice challenged. For serious arrears under Ground 8, for example, the notice period is four weeks, and the arrears must still be unpaid at the hearing. Our Ground 8 guide and the comparison of Grounds 10 and 11 show how the grounds fit together.
The pre-action compliance checklist
Before you serve anything, check what a court will test: deposit protection and prescribed information, gas safety, EPC, How to Rent guide, electrical safety, Right to Rent and licensing. Our deposit protection guide explains the deposit rules in detail. An unprotected deposit can block a claim and expose you to a compensation order of one to three times the deposit.
Rent arrears: the smart sequence
For arrears claims the Playbook sets out how to stack Grounds 8, 10 and 11 so that you are covered if the arrears dip before the hearing, and how to keep records that win cases. It also covers the court process (the N5 and N119 forms), costs and realistic timelines.
What is inside the Playbook
The Playbook has 31 pages and 23 chapters: the big change, the grounds that matter, Form 3A, serving notice correctly, official forms with gov.uk links, worked examples (one claim that holds, one that loses on a compliance slip), the 10 mistakes that get claims dismissed, a 12-month compliance calendar and an FAQ. Version 1.1 adds rent increases (Section 13 and Form 4A, see how to increase rent), rent repayment orders and a notice-period table for every ground.
